Vivant Dolls Concierge Terms & Conditions
These terms apply to Vivant Dolls’ Private Receiving and Assisted Purchase concierge services. By using the service, you agree to the terms applicable to your transaction.
The Seller Is Still the Seller
Whether you place the order yourself or Vivant Dolls places it at your direction, the company selling the product is an independent third party.
Vivant Dolls has no relationship or affiliation with third-party retailers used through this service.
You choose the retailer and the product. Vivant Dolls does not investigate, certify, endorse, or guarantee third-party sellers, their inventory, their products, or their representations.
Vivant Dolls provides concierge and receiving services. Vivant Dolls does not become the manufacturer or seller of a third-party product by receiving the package or placing an order at your direction.
Third-Party Seller and Product Risk
Vivant Dolls cannot guarantee that a third-party seller actually has an advertised item in stock; sends the exact item pictured, ordered, or described; provides an authentic or correctly configured product; delivers a product free from defects or damage; fulfills the order at all; remains in business; honors warranties, returns, refunds, replacements, or other promises; or otherwise performs as advertised.
Those risks remain between you and the third-party seller.
Vivant Dolls is not responsible for non-delivery, substitution of another product, counterfeit or inauthentic goods, misrepresentation, defects, seller or carrier-related damage, seller insolvency, fraud, or other failures by the third-party seller or carrier.
Receiving a package at Vivant Dolls does not constitute inspection, authentication, verification, or acceptance of its contents or condition.
Shipping and Delivery Times
Third-party shipping times are outside Vivant Dolls’ control.
Any manufacturing, processing, shipping, customs, tracking, or delivery estimate provided by a seller or carrier is their estimate, not a Vivant Dolls guarantee.
Vivant Dolls does not control when a seller processes an order, whether an item is actually ready to ship, customs delays, carrier delays, inaccurate or delayed tracking updates, delivery attempts, or the seller’s responsiveness.
Vivant Dolls will notify you when it has confirmed that your package has arrived and is ready for pickup, but no particular arrival or pickup date is guaranteed unless Vivant Dolls specifically agrees otherwise in writing.
Private Receiving
Private Receiving is available only after Vivant Dolls confirms the receiving arrangement. The customer purchases directly from the third-party seller and uses shipping information supplied by Vivant Dolls.
The customer must provide the carrier and tracking number promptly when the seller provides it and before delivery whenever reasonably possible. If tracking is unavailable, the customer must keep Vivant Dolls informed of the expected delivery date and promptly provide delivery updates received from the seller or carrier.
Do not ship property to Vivant Dolls without prior confirmation of the receiving arrangement.
Assisted Purchase
For Assisted Purchase transactions, Vivant Dolls acts as your purchasing agent and follows your instructions.
Before Vivant Dolls places the order, you must approve the exact purchase, pay the required amount, and confirm in writing that you accept these terms.
Your total may include the seller’s purchase price, taxes, shipping or freight, seller-imposed transaction charges, other costs associated with the purchase, and Vivant Dolls’ concierge fee.
Once you authorize the purchase and Vivant Dolls transmits the funds to the third-party seller, Vivant Dolls is not responsible for refunding money already paid to that seller if the seller later fails to perform.
That includes non-delivery, substitution, counterfeit or misrepresented products, defects, insolvency, fraud, or other seller failures.
If funds are actually recovered from the seller or payment provider and belong to you, those recovered purchase funds will be passed back to you.
Concierge and Receiving Fees
The applicable fee compensates Vivant Dolls for the services it provides, including arranging and placing the transaction when applicable, receiving the shipment, providing a private delivery location, holding the package for pickup, and associated administration.
For an Assisted Purchase, the concierge fee is earned and becomes nonrefundable once Vivant Dolls places the third-party order.
For Private Receiving, the receiving fee is earned once Vivant Dolls receives the shipment.
A problem with the third-party seller or carrier does not make Vivant Dolls responsible for refunding a service that Vivant Dolls has already performed.
Pickup and Storage
Your concierge or receiving fee includes storage for 30 calendar days after Vivant Dolls notifies you that your package is ready for pickup.
Beginning on day 31, storage is $10 per day and is due as it accrues.
If property remains unclaimed and storage charges remain unpaid, Vivant Dolls may exercise any rights available under California law, including asserting a lien and pursuing lawful sale or other disposition of the property after any legally required waiting periods, notices, or procedures.
Nothing in these terms eliminates any notice, redemption, or other right that applicable California law requires.
Final Orders and Third-Party Disputes
For an Assisted Purchase, once you approve the exact purchase and Vivant Dolls places the order with the third-party seller at your direction, the concierge transaction is final through Vivant Dolls.
For Private Receiving, your purchase remains your transaction directly with the third-party seller.
Any product return, refund, warranty, replacement, authenticity, condition, shipping, or other dispute remains between you and that seller or carrier unless Vivant Dolls separately agrees in writing to assist.
If a problem arises, Vivant Dolls will reasonably cooperate by providing documentation in its possession relating to the order or delivery, but Vivant Dolls does not assume the seller’s or carrier’s obligations.
